Terms of Sales

These conditions of sale are concluded on one hand by the company WARM with a capital of 20,000 euros whose head office is in Laval (France), registered in the Laval Trade and Companies Register under number 818 055 691 00013 here -after referred to as “WARM” and on another hand, by any natural or legal person wishing to make a purchase through the website of “WARM” hereinafter referred to as “the buyer” or “customer”.

Article 1. Term of application

These conditions of sale concern the products sold on the site www.warm-ed.fr.

Article 2. Orders

Orders are placed on the website www.warm-ed.fr.

The contractual information, written in French, appears on the order confirmation document.

The validation of your order supposes the full and complete acceptance of these conditions of sale.

WARM reserves the right to refuse an order from a customer with whom there is a dispute concerning the payment of a previous order.

Under Article L120-20 of the Consumer Code, the customer has a period of seven clear days to exercise his right of withdrawal without having to provide justification or suffer penalties. The customer is then reimbursed (with the exception of the cost of returning the product, which remains his responsibility).

Packaged items must be returned in their original, undamaged packaging.

Article 3. Availability

Information on the availability of titles is subject to errors. In this case, after checking availability, you will receive an email indicating the delivery time and, in the event of unavailability, your order will be immediately canceled and refunded if necessary.

Pre-order : The titles to be published which are offered on this site are dispatched from the date of sale. WARM cannot be held responsible for any delay in the marketing date. The products offered on this site are shipped from the date of sale.

Article 4. Price

Our prices are indicated in euros, all taxes included (excluding preparation and shipping costs which depend on the shipping zone and are calculated before confirmation of the order).

The articles are sold in strict compliance with French regulations on the price of books, and in particular of Law Lang 81-766 of August 10, 1981 on the single price of books.

Prices may be updated at any time without notice, but items are billed on the basis of the current price, displayed when the order is placed.

Article 5. Shipping fees

Shipping costs are calculated as accurately as possible according to your delivery address and the total weight of your order. You can have an estimate by putting items that interest you in the cart.

Article 6. Invoices

Orders are invoiced and payable in euros.

Any customs charges or local taxes for deliveries outside mainland France remain the responsibility of the recipient, who is then the importer.

For shipments outside the European Union and DOM-TOM, the price will be calculated excluding tax automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the WARM site. They are your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and / or bodies in your country.

The items delivered and invoiced remain the property of WARM until full payment of the price.

Payment is made by bank cards (Visa, Eurocard, Mastercard).

Regarding payments by check, delivery occurs as soon as the collection is effective.

Article 7. Secure payments

Payment by credit card on the warm-ed.fr site is fully secure and encrypted by our banking establishment, Banque Populaire de l’Ouest (BPO). Sensitive information transmitted at the time of payment is SSL encrypted.

Article 8. Delivery

WARM, as part of its sales contract, is fully responsible for the delivery and transport of the items (books, records, etc.), to the address indicated at the time of the order, the inherent costs being accessories of these operations.

In the event of a dispute on delivery, any complaint must be sent within 48 hours to: WARM, 1ter rue André de Lohéac 53000 Laval, in addition to any reservations made to the carrier under the legal conditions.

Responsibility for the risk of loss or destruction lies with the purchaser upon delivery, even if he is not the owner of the goods delivered. He personally bears any insurance charges.

The delivery time includes the preparation time of the package plus the delivery time. The “Delivery times” section tells you how to calculate your delivery time. The “Shipping costs” section will show you the prices and associated times, which we offer by destination.

The average times indicated do not constitute a strict deadline and WARM cannot be held liable in the event of late delivery.

In the event of a shipment delay, you will be notified by email. In this case, and as long as the item has not been dispatched, you can cancel your order.

Note : orders paid by check will only be processed upon receipt of the check and the deadlines will run accordingly.

Orders not served within 30 days will be canceled unless otherwise specified.

Some countries restrict the entry of goods into their territory. It is the buyer’s responsibility to ensure the conditions of access for the items ordered in the country of destination.

WARM cannot be held responsible for any destruction or blockage of the package upon entry into the country of destination.

Article 9. Delivery delay

Deliveries are made from Monday to Saturday inclusive (except public holidays).

Any order that reaches us before noon is processed the same day.

The times announced are the average times observed.

To calculate your delivery time, refer to the indication on the product description.

Article 10. Return of goods

Items shipped by WARM are new and guaranteed to be free from defects. If it happens that an item is defective (badly paginated, badly printed, badly pressed, etc.), we promise to exchange or refund it to you. Are new and guaranteed against any defect.

Packaged items can only be taken back in their original packaging, not unsealed.

You can send your return package, in standard shipment, the items concerned in their original packaging and accompanied by a copy of the corresponding invoice, within 15 days of receipt of the package to : WARM 9 rue d’Aubert 53000 Laval – FRANCE.

The return costs will be reimbursed to you (within the limit of the cost of sending in standard mode) and the exchange will be implemented immediately. In the event of a refund, we guarantee that it is made by check within a period of less than or equal to 15 days following the date of receipt of the returned package. No cash on delivery will be accepted, whatever the reason.

Article 11. Disputes

In the event of a dispute, French law applies and the competent court is the court of Laval.

Article 12. Personal information

We collect personal information which is useful for processing your order.
